Ordinance No. 363 AMENDMENT TO CODE TO THE CITY OF LE SUEUR, MINNESOTA BEING AN ORDINANCE AMENDING CHAPTER 26 OF THE CITY OF LE SUEUR RELATING TO PARKING.
Section 1. Chapter 26, Division 2 of the City Code is amended to read: Division 2. Emergencies due to snow, sleet and natural phenomenons, Section 26-31 Determination of Existence and Duration of Emergency; Publication of Notice.
Whenever in the opinion of those persons who are selected by Resolution of the Common Council an emergency exists in the City or in a section or sections thereof because of snow, freezing rain, sleet, ice, snow drifts or other natural phenomenons which create or are likely to create hazardous conditions which impede or are likely to impede the free movement of fire, police, snow removal equipment, emergency or other vehicles or traffic for the safety and welfare of the community, those persons who are selected by Resolution of the Common Council may declare an emergency to exist until such time as such emergency is terminated by those persons who are selected by Resolution of the Common Council. Notice of such emergency shall be given by such news media as radio, television or press which news media shall be requested to cooperate with the City and when such notice is given, the same shall constitute due and proper notice. Such notice shall specify the time at which the emergency shall also be given by such news media and such notice shall specify the time at which such emergency is terminated.
Section 26-32 Parking Restrictions During Emergency During the period of any such emergency as hereinbefore in this division provided for, the following restrictions on parking shall be in effect:
- No vehicle shall be parked or left unattended on any portion of the following public streets within the City between the hours of 12:00 midnight and 6:00 a.m.:
- On Main Street between Cathcart Street and Bridge Street and between Ferry Street and Smith Street.
- On Second Street between Swan Street and Ferry Street.
- On Ferry Street between Third Street and the Easterly right of way of Chicago Northwestern Railway.
- On Bridge Street between Fifth Street and the Easterly right of way of the Chicago Northwestern Railway.
- On Swan Street between Second Street and Main Street.
- On all public streets within the City other than those designated in Subsection (a) hereof, all vehicles shall be removed from any public street or portion thereof where snow removal has not been completed during such emergency period as soon as reasonably possible and in all events within twenty-four (24) hours of the commencement of such emergency.
Section 26-33 Removal by Police of Vehicles in Violation. The Police Department is hereby empowered to cause any vehicle parked or left unattended in violation of the provisions of this division to be towed to such place as the Common Council may from time to time designate for storage purposes, which towing and storage shall be at the sole expense of the owner of said vehicle. All fees for towing and storage shall be paid in addition to the fine imposed for violation of this division, before such vehicle shall be released.
Section 26-34 Penalty. Any person convicted of violating any provision of this division is guilty of a petty misdemeanor.
Section 2. Effective Date. This Ordinance becomes effective from and after its passage and seven days after publication.
